| ILAG National Report 2003 - Market Competition and Legal Aid in Norway | Professor Jon T. Johnsen | During the last year, reform activity on legal aid in Norway has been more intense than for long. At the end of 2002 the Ministry of Justice proposed a bundle of reforms in the Norwegian Legal Aid Act of 1981. The package contains revised goals for the civil schemes – emphasizing legal aid as a rationed, discretionary distributed welfare benefit, new rules emphasizing that legal aid is subsidiary to legal insurance, changes in the means and merits test and in the administrative powers to exempt from them. A majority in Parliament has instructed the present minority government to abandon contributions in legal aid. The Dutch constitution enshrines the principles that all citizens should have access to justice and a right to legal representation and legal aid1. For many decades these fundamental rights have been regulated in specific legislation and delegated legislation. A new Legal Aid Act (Wet op de rechtsbijstand) came into force in 1994, thereby replacing a former statute for the provision of legal aid to the indigent or people of modest means. | ILAG National Report 2003 - The Legal Aid Board and the Delivery of Legal Aid Service in South Africa | David McQuoid-Mason | For the past three decades the Legal Aid Board has been the main vehicle for the delivery of legal aid services in South Africa. The Board was established by the Legal Aid Act in 19691 and began operating a national legal aid scheme in 1971. It was given very general powers to ‘to render or make available legal aid to indigent people’ and drew up a detailed Legal Aid Guide which contained a large number of exclusions in respect of both civil and criminal matters. | ILAG National Report 2007 - England and Wales | Carolyn Regan | The Legal Services Commission (LSC) was established under the Access to Justice Act 1999, replacing the Legal Aid Board in April 2000. We are a non-departmental public body sponsored by the Ministry of Justice (MoJ), (which was created by the Department for Constitutional Affairs coming together with the National Offender Management Service and Office of Criminal Justice Reform on 9 May 2007). The Secretary of State for Justice is accountable to Parliament for our activities and performance. The MoJ agrees its overarching Public Service Agreement targets with the Treasury. The LSC in turn sets its objectives in discussion with the MoJ. A board of independent Commissioners oversees our work. The Lord Chancellor appoints our Commissioners, who are responsible for establishing and maintaining the overall strategic direction of the LSC within an agreed framework.
